Privacy Policy pursuant to Article 13 of European Regulation 2016/679 (GDPR)
Data Controller
(Article 13(1)(a), Article 15(b) GDPR).
The Data Controller is GAFITEX SRL (hereinafter referred to as “Data Controller”), in the person of its pro-tempore legal representative, with registered office in GUIDIZZOLO (MN) VIA CAVRIANA 14
Personal data is collected by the Data Controller through registration and storage in our paper and electronic databases.
The processing is based on the principles of fairness, lawfulness, transparency, purpose and retention limitation, data minimisation, accuracy, integrity, confidentiality and accountability.
Data Protection Officer
The designated Data Protection Officer is the point of contact for data subjects who wish to receive information on the processing of their data and/or for the Supervisory Authority; he/she can be contacted at the e-mail address cristina@gafitex.com.
Data acquisition
Gafitex Srl, in the person of its pro-tempore legal representative, with registered office in GUIDIZZOLO (MN) VIA CAVRIANA 14, acts as Data Controller and can be contacted at cristina@gafitex.com and collects and/or receives information concerning the Data Subject, such as:

The data controller, even without your explicit consent, may use the contact data communicated by the data subject for the purpose of direct sales of products, limited to products similar to those being sold, unless the data subject explicitly objects.
Purposes of the processing for which the data are intended and legal basis
The data collected and processed will be used exclusively for the following purposes:
- a) To comply with a customer/company contract
- b) Communication to third parties for tax and administrative management.
The processing of personal data – including any sensitive data (“special categories of data”) and relating to criminal convictions or offences (“judicial”) for which your consent is required to be expressed at the foot of this notice – collected for the management purposes identified above.

Nature of data provision
The provision of personal data and the consequent processing by the Data Controller, for the purposes set out above, are necessary for the establishment, continuation and proper management of the relationship between the Data Controller and the Data Subject or must be considered as mandatory under the law, regulation or EU legislation; refusal to provide the personal data requested may make it impossible, in whole or in part, to complete and manage the existing or future relationship. The provision of personal data and the consequent processing by the Data Controller for the purposes referred to in point A/B is optional and failure to provide such data, even in part, will not entail any consequences.
Methods of data processing
The data will be processed – by the persons in charge of the processing – with manual, computer and telematic tools within and in accordance with the purposes specified above and, in any case, always respecting the security and confidentiality of these purposes, also in accordance with the law and the provisions of the Italian Data Protection Authority.
Categories of subjects to whom the data may be communicated:
The processing of personal data will be carried out by means of subjects expressly and specifically designated as specially trained appointees; these subjects will process the data in accordance with the instructions received from the Data Controller, according to operational profiles attributed to them in relation to the functions performed.
The data may also be processed by third parties (outsourcers), which we use for the provision of services related to the purposes pursued, which our organisation assesses from time to time, to ensure greater protection, where appointed as external data processors. In all cases, these persons will process the data in accordance with the instructions received from the Data Controller, according to the operating profiles assigned to them in relation to the functions performed, to the extent necessary and instrumental in order to execute specific operations within the scope of the services requested and exclusively for the purposes indicated in this Privacy Policy.
The data will not be subject to dissemination
Duration and retention of processing
The data collected will be kept for a period of time not exceeding that necessary for the purposes for which it was collected, to fulfil contractual or pre-contractual obligations, by law and /or regulation (without prejudice to statutory limitations and time limits of rights and in compliance with resulting obligations).
In particular, the criteria used to determine the retention period are established by specific legal provisions regulating the activity of the Data Controller e.g. tax legislation as regards the processing of administrative-accounting data or specific provisions of the Italian Data Protection Authority that have regulated the processing activity and the purposes pursued by the Data Controller; finally, it should be noted that your personal data may be retained up to the time allowed by the Italian law.
Rights of the data subject:
The data subject has the rights to:
- obtaining the cancellation or transformation into anonymous form or the blocking of data that has been processed in breach of the law;
- obtaining the updating, rectification and integration of data;
- obtaining the certification that these operations have been brought to the attention of those to whom the data is communicated;
- opposing on legitimate grounds the processing of data or any automated decision-making process (including profiling);
- obtain restriction of processing or portability to another data controller.
For this purpose, it will be necessary to send the request, through specific communication by e-mail addressed to cristina@gafitex.com (specifying in the object “Privacy”) or by registered letter with acknowledgement of receipt to GAFITEX SRL.
Please also note that the data subject always has the right to lodge a complaint with the Italian Data Protection Authority for the exercise of his/her rights or for any other matter relating to the processing of his/her personal data.
The data subject always has the right to revoke the consent to the processing given for the purposes indicated above, without prejudice to the lawfulness of the processing based on the consent given before the revocation.
